Release of Liability, Waiver of Claims, Assumption of Risks & Indemnity Agreement
Introduction This Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement (“Agreement”) is entered into between U.Golf Entertainment™, owned and operated by Jesus Valenzuela, and the undersigned participant (“Participant”).
Participation includes entering the simulator area, standing near the equipment, observing others, or being present within the designated activity zone.
This Agreement applies to:
• The Participant
• Any minors under the Participant’s care or supervision
• Any individuals the Participant brings to the event or allows to participate
• Any guests who enter the simulator area under the Participant’s responsibility
• Any corporate employees, contractors, or attendees participating under a company booking For the purposes of this Agreement, “U.Golf Entertainment” includes:
• Owner: Jesus Valenzuela
• The business entity: U.Golf Entertainment • Employees
• Independent contractors
• Event staff and assistants
• Volunteers
• Agents and representatives
• Corporate partners, venue hosts, and affiliated organizations
By signing or participating, the Participant acknowledges that they have read, understood, and voluntarily agree to all terms contained in this Agreement.
1. Participant Information

Event Organizer Information
By submitting this form, I confirm that I am the designated event organizer for this booking. I have read, understand, and agree to all rules, safety guidelines, and operational requirements provided by U.Golf Entertainment. I acknowledge that it is my responsibility to communicate these guidelines to all participants and ensure compliance throughout the event. I understand that failure to follow the rules may result in paused gameplay, removal of participants, or early shutdown of the activity if necessary to maintain a safe environment for all guests.
2. Assumption of Risk
The Participant understands that participating in the U.Golf Entertainment mobile golf simulator experience involves inherent risks, including but not limited to:
• Being struck by a golf club or golf ball
• Slips, trips, or falls on turf, mats, cables, or temporary flooring
• Contact with simulator walls, screens, or equipment
• Equipment malfunction or unexpected movement
• Physical exertion, muscle strain, or fatigue
• Noise, lighting, or motion effects
• Actions of other participants
• Reckless, negligent, or intoxicated behavior of others
• Weather‑related hazards for outdoor or semi‑outdoor events
• Serious injury, illness, or, in rare cases, death
The Participant understands that these risks cannot be eliminated without fundamentally altering the nature of the activity.
The Participant voluntarily assumes all risks, known and unknown, whether arising from their own actions, the actions of others, environmental conditions, or the negligence of U.Golf Entertainment, to the fullest extent permitted by law.
3. Release of Liability
In consideration for being allowed to participate, the Participant releases, waives, and discharges U.Golf Entertainment, its owners, employees, contractors, agents, volunteers, and event partners from any and all liability for:
• Personal injury
• Property damage
• Accidents or incidents arising from participation
• Claims arising from ordinary negligence
• Any other loss arising from participation
This release does not apply to gross negligence or willful misconduct, which cannot be waived under California law.
This release applies to the Participant and their heirs, executors, administrators, and assigns.
4. Indemnification Agreement
The Participant agrees to indemnify, defend, and hold harmless U.Golf Entertainment from any claims, demands, actions, or damages arising out of:
• The Participant’s participation
• Failure to follow safety instructions
• Negligent, reckless, or intentional actions
• Injuries or damages caused to others
• Damage caused to equipment or property
• Corporate employees or guests participating under the Participant’s organization
• Claims brought by third parties
This includes attorney fees, legal costs, and all expenses incurred in defending such claims.
5. Participant Responsibilities

I agree to:
• Follow all instructions from U.Golf staff
• Maintain a safe distance from swinging clubs
• Use equipment only as directed
• All shots must be hit from the designated striking area. No exceptions.
• All shots must be aimed at the screen. Intentional mis-hits will result in immediate removal.
• No trick shots, “Happy Gilmore” swings, wall bounces, or club throwing.
• No food, drinks, gum, or sticky items inside the simulator enclosure.
• Avoid running, horseplay, or unsafe behavior
• Supervise children at all times
• Report unsafe conditions immediately
• Be respectful of the equipment and others
Failure to follow rules may result in removal without refund.
6. Health Acknowledgment

I confirm that:
• I am physically able to participate
• I do not have medical conditions that make participation unsafe
• I will stop if I feel pain, dizziness, or discomfort
I understand U.Golf Entertainment does not provide medical services.
7. Damage Responsibility
The Participant agrees to be financially responsible for any intentional or reckless damage they cause to:
• Launch monitors
• Projectors
• Screens and enclosures
• Turf, mats, or flooring
• Clubs, balls, or accessories
• Electrical or lighting equipment
The Participant understands that replacement costs for specialized simulator equipment may exceed several thousand dollars.
Corporate clients acknowledge responsibility for damage caused by their employees or guests.
8. Photo & Video Consent (Optional)
The Participant grants U.Golf Entertainment permission to use photos or videos taken during the event for marketing, promotional, print, digital, social, or commercial purposes.
Media may be captured:
• During setup
• During event operation
• Throughout the duration of the event
If the Participant does not consent, they must notify staff before entering the simulator area.
Parents and guardians acknowledge acceptance of this section on behalf of minors.
9. California Law Disclosure
This Agreement is governed by the laws of the State of California. The Participant understands:
• California does not allow waivers for gross negligence or willful misconduct
• This waiver applies only to the extent permitted by law
• If any portion is invalid, the remainder stays in effect
10. Minor Participants (If Applicable)
If the Participant is under 18 years of age:
The parent or legal guardian consents to the minor’s participation and agrees to all terms of this Agreement on their behalf.
The guardian assumes all risks associated with the minor’s participation and agrees to indemnify U.Golf Entertainment for any claims arising from the minor’s actions.
Minors may not participate without a parent or legal guardian’s signature.
Minor Consent Form
By submitting this form, I confirm that I am the parent or legal guardian of the participating minor(s). I have read, understand, and agree to all rules, safety guidelines, and instructions provided by U.Golf Entertainment. I accept responsibility for ensuring that the minor(s) under my supervision follow these requirements at all times. I understand that failure to comply may result in loss of playtime or removal from the activity to maintain a safe environment for all guests.
11. Acknowledgment & Signature
By submitting the form below, the Participant acknowledges that:
• They have read and understand this Agreement
• They voluntarily accept all risks
• They agree to all terms and indemnification clauses
• They are legally competent to sign Participant
